Kim Zolciak is pushing back against estranged husband Kroy Biermann's allegations that she neglected their children, claiming a recent custody decision was made without proper testimony from key witnesses.
The 47-year-old former Real Housewives of Atlanta star, who temporarily lost primary physical custody of the couple's four children, stated in legal documents obtained by the Daily Mail that a family therapist was not present at the hearing despite being subpoenaed. She also alleged she was denied the chance to question the court-ordered lawyer and expose what she calls 'Kroy’s lies' regarding custody recommendations.
Zolciak has requested that the emergency order, which granted Biermann sole custody of K.J. (14), Kash (13), and twins Kaia and Kane (12), be overturned. The former couple will continue to share joint legal custody, but Biermann was awarded final authority over major decisions involving education, non-emergency medical care, and religious upbringing.
In a statement to the Daily Mail and on her Instagram Stories, Zolciak described the ruling as temporary, pending a full hearing. She claimed the emergency motion was filed to ensure the matter was heard by a senior judge rather than their assigned judge, who she says has never granted Biermann an immediate hearing on his previous motions.
Earlier in April, Biermann, a retired NFL star, filed for emergency custody, alleging Zolciak was 'unstable and unfit' and had mismanaged basic parenting responsibilities. Zolciak refuted those claims, stating she had been working on TV shows to support the family and that the accusations were false attempts to defame her character.
In addition to her four youngest children, Zolciak is also mother to daughters Brielle (29) and Ariana (24), whom Biermann adopted in 2013.
