Mother Sentenced to 15 Years for Tragic Hot Car Death of Infant Son

A 20-year-old mother has been sentenced to 15 years in prison after her one-year-old son died in a sweltering car while she underwent a cosmetic procedure. Maya Hernandez left her baby, Amillio, and his two-year-old brother in a vehicle for over two hours as she visited a medical spa for a Brazilian Butt Lift (BBL).

Fatal Neglect During Cosmetic Appointment

The tragic incident occurred when Hernandez's appointment was delayed, and she failed to check on her children. Witnesses confirmed she never mentioned bringing the children with her or attempted to monitor their wellbeing during the extended wait.

Hernandez testified that she believed the car would remain cool with the air conditioning running, monitoring the situation through a phone app. However, the vehicle's air conditioning system shut off after approximately one hour, as external temperatures soared to 38°C. Inside the car, conditions became even more extreme, with temperatures exceeding 40°C.

Medical Emergency and Legal Consequences

Trapped in the intense heat, baby Amillio began foaming at the mouth before suffering a seizure. He was rushed to hospital with a body temperature of 41°C but was pronounced dead at 5:48pm. Hernandez pleaded no contest to involuntary manslaughter charges.

Last Thursday, Judge Charles Brehmer imposed the 15-year fixed prison term, emphasizing the severity of the neglect that led to the child's preventable death. The case has drawn significant attention to parental responsibility and the dangers of leaving children unattended in vehicles.

Parallel Case of Child Neglect Emerges

This harrowing trial follows another disturbing child neglect case in Ireland, where a 31-year-old mother pleaded guilty to three counts of neglect between 2018 and 2023. The woman cannot be named to protect her children's identities, including a baby boy under one year old, an older boy aged four to eight, and a girl aged seven to nine.

An investigating garda revealed that concerns were raised by a school principal, leading to a Tusla referral in July 2023. Social workers subsequently met with the girl, who made allegations about her mother's behavior. The court heard the woman struggled with drug addiction and had experienced multiple family deaths, including her husband's suicide in late 2022.

During specialist interviews, the older children separately described witnessing their mother slap the crying baby on multiple occasions, including across the face. The boy recounted his mother threatening his sister at their father's grave, saying "If you don't stop crying, I'm going to put you down beside Daddy." The girl also reported being kicked in the leg by her mother.

Both children described how the girl often assumed caregiving responsibilities, including cooking and cleaning, while their mother was frequently absent from the home. The woman faces a maximum sentence of seven years imprisonment for these offences, with sentencing pending.
