Arrogant Driver Seen Smirking Outside Court Before Breaking Down in Tears Over Jail Sentence
In a shocking display of contempt, an arrogant driver who killed a young woman was captured on camera smirking outside court just moments before he cried over being sentenced to nine years behind bars. Dean Tolan, 36, pleaded guilty to causing the death of 29-year-old Ellie Smart by dangerous driving in a horrific crash that has devastated a family and community.
Footage Reveals Callous Behaviour Before Sentencing
Footage from Sheffield Crown Court showed Tolan arriving for his sentencing hearing, appearing to use his hands-free phone function while smirking openly. He was also seen joking with others and carrying a large overnight bag as he waited to enter the building, displaying what the judge would later describe as "errant disregard and arrogance" for the rules.
The stark contrast between his pre-sentencing behaviour and his emotional breakdown in the dock was particularly jarring. Tolan later sobbed uncontrollably as Judge Jeremy Richardson KC handed down the nine-year prison sentence for the crash that occurred on January 25, 2024, in Sheffield, South Yorkshire.
Multiple Violations Compounded the Tragedy
The court heard how Tolan's dangerous driving was compounded by multiple violations. He was speeding at 58 miles per hour when he fatally struck Ms Smart as she attempted to cross the road. Additionally, he was not wearing his glasses despite this being a condition of his driving licence, and his mobile phone was connected to his vehicle's Bluetooth, with evidence showing he had used it within seconds of the crash occurring.
Prosecutor Laura Marshall revealed that Tolan failed several roadside eyesight tests following the collision. He falsely claimed that he had only noticed emerging issues with his eyesight in the days prior to the crash, a statement that further demonstrated his attempt to evade responsibility.
Judge Condemns "Spectacular Arrogance"
Judge Richardson was scathing in his assessment of Tolan's behaviour, both during the incident and afterwards. "You displayed spectacular arrogance; you also displayed arrogance and a lack of basic humanity when you were interviewed by police, seeking to blame the deceased, the DVLA and your optician," the judge stated during sentencing.
The judge emphasized the profound loss caused by Tolan's actions: "You caused the death of a delightful young woman aged 29 years who had her whole life ahead of her. You eradicated that." Shockingly, the hearing revealed that Tolan had even sought to blame Ms Smart after her death, claiming she rushed out in front of him and left him no chance to brake.
Family's Heartbreaking Loss
In a powerful victim impact statement, Ms Smart's parents described how they had been left heartbroken after watching their daughter "slip away" just hours after the crash. Ms Smart, a first-class communications graduate who worked in South Yorkshire Police's press office, had visited her parents on the morning of the fatal collision.
Her parents, who lived a short distance away from her, revealed they felt they had no choice but to leave Sheffield following the tragedy. They expressed devastation that their daughter would never get married, have a family of her own, or be there to watch her niece grow up—a future brutally stolen by Tolan's dangerous actions.
Legal Consequences and Driving Ban
In addition to the nine-year prison sentence, Tolan has been banned from driving for ten years. The case has highlighted serious concerns about driver accountability and the consequences of violating licence conditions. The combination of speeding, mobile phone use, and failure to wear required corrective lenses created a perfect storm of negligence that resulted in irreversible tragedy.
