Mother's Conviction and Trial Proceedings

Amy Clark, Darcy's 34-year-old mother, was found guilty of causing or allowing the death of a child and two counts of causing or allowing serious harm to a child. Charges of murder or manslaughter against her were dropped by prosecutors during closing speeches. She was acquitted of two counts of causing grievous bodily harm with intent.

During the trial, the court heard that Clark presented herself as a capable mother while concealing significant alcohol and cocaine use. Sandhu described her life as "more chaotic" beneath the veneer of order, directly flowing from her substance abuse. The jury foreperson wiped tears from her eyes as Judge Mrs Justice Brunner KC thanked the panel for their attention to the "upsetting" case and excused them from future jury service for life.

Sandhu noted in his closing address that while it was their right to remain silent, their decision not to provide explanations for their daughter's injuries and death was "telling" and "deafening." The court heard disturbing details about the parents' relationship, including a message Jefferson sent Clark in September 2021 while she was pregnant, threatening to "put you 6ft underground" if she killed her baby through drinking. Jefferson was also a substance user, smoking cannabis in the garage during what was described as a hostile and dispute-ridden relationship.

Prosecutors argued that the dynamics between Jefferson and Clark provided context for understanding how Darcy "came to be assaulted repeatedly and killed." Sandhu stated that one parent caused the rib fractures in the first couple weeks of Darcy's life while the other allowed them to happen, and similarly with later fractures and ultimately her death.

Judge Brunner informed the defendants that sentencing would occur at a later date to be determined administratively. Darcy had arrived five weeks early on February 20, 2022, and was physically assaulted on a repeated basis during her short life, according to trial evidence.
