Rapper Convicted Over Fatal XL Bully Dog Attack on Pensioner

An aspiring rapper has been found guilty of being in charge of two XL bully dogs that mauled a 68-year-old woman to death in a case described as a "tragedy waiting to happen." Ashley Warren, 41, was convicted at Chelmsford Crown Court for owning or being in charge of the dogs involved in the fatal attack on Esther Martin.

Details of the Fatal Incident

The court heard that Warren left Ms Martin with two adult XL bullies, named Beauty and Bear, along with eight puppies of the same breed, at his home in Jaywick, Essex, on February 3, 2024. A child was also present in the property during the attack. Jurors viewed footage from the residential street that captured the dogs' aggressive barking and the screams of both the victim and the child as the mauling unfolded.

Prosecutors presented video evidence showing police officers entering the property with riot shields and deploying Tasers in response to the incident. Ms Martin, who stood at 5 feet 3 inches tall and had limited mobility following a hip replacement, sustained "dozens and dozens" of injuries in the brutal attack, ultimately leading to her death.

Warren's Defence and Prosecution Arguments

During the trial, Warren testified that he "would never have left Esther with the dogs if I thought they were dangerous" and "never thought for one second this would happen." He explained that he had asked Ms Martin, whom he had known for over 12 years, to mind the animals so he could travel to London to film a music video.

However, prosecutor Chris Paxton KC argued that Warren should have been aware of Ms Martin's mobility issues and had "no basis" to believe she could "physically stop the dogs." Paxton emphasized, "The defendant is responsible as the owner of Bear, and being in charge of Beauty, because no-one, no-one could reasonably believe that Esther Martin was a fit and proper person." He added that it was unreasonable to expect her to control two powerful adult XL bullies, especially with eight puppies also present.

Legal Context and Verdict

The fatal mauling occurred just two days after the Government made it a criminal offence to own an XL bully in England and Wales without a certificate of exemption. Warren, now residing in Addlestone, Surrey, had pleaded not guilty to charges of being the owner of Bear and in charge of Beauty, both dogs causing injury resulting in death while dangerously out of control in a private place. He also denied possessing a bladed article without good reason at Clacton railway station on the same day.

After being sent out to deliberate on Tuesday morning by Mr Justice Jeremy Johnson KC, the jurors returned their verdicts, finding Warren guilty on the dog-related charges. The case highlights ongoing concerns about dangerous dog breeds and owner responsibility, particularly in light of recent regulatory changes.
