The video, posted in November, prompted Trump to accuse the lawmakers of "seditious behavior" on Truth Social, even calling for their arrests and suggesting such behavior was "punishable by DEATH!".

The U.S. Attorney's Office in Washington D.C., led by Jeanine Pirro, pursued the indictment. A former prosecutor who once worked in that office told Politico Magazine that it is "stunning" for a grand jury to completely reject an indictment, given the rules heavily favor prosecutors.

Former Prosecutor Criticizes Office Conditions

The former prosecutor, speaking anonymously, described the current Washington office as having a "hollowed-out core of increasingly inexperienced and overworked D.C. assistant U.S. attorneys." They added that staff are spending time reviewing the Jeffrey Epstein files and questioning their "red line" for resignation.

"I think good cases aren't being brought because people are either afraid or lack bandwidth," the former prosecutor said. "D.C. had one of the most prestigious U.S. Attorney's offices in the country, and to see it become a shadow of itself in a year is sad."

Pirro Defends Her Office's Actions

In response, Jeanine Pirro told Politico Magazine that her responsibility is to "follow the law." She emphasized that the justice system allows grand juries and trial juries to review evidence and make their own decisions, stating that political passions are irrelevant to their focus on the law.

Democratic Lawmakers Respond to Failed Indictment

After the failed indictment attempt was revealed, Democratic lawmakers featured in the video spoke out against the Trump administration. Senator Mark Kelly, a former NASA astronaut and retired U.S. Navy Captain, said the "most patriotic thing any of us can do is not back down." Senator Elissa Slotkin, a former CIA analyst, expressed hope that the grand jury's rejection "ends this politicized investigation for good."

History of High-Profile Failures

This is not the first time Pirro's office has failed to secure a high-profile indictment. Last year, her office attempted to bring a felony charge against a man accused of throwing a sandwich at a federal agent, a case that gained nationwide attention and dubbed the man "Sandwich Guy." The charge was later downgraded, and a jury found him not guilty of misdemeanor assault.
