ARN Media, the broadcaster, sacked Sandilands last week, alleging serious misconduct and a breach of their services agreement with Quasar Media. This action deprived Sandilands of the remaining $85 million he would have earned if the contract had continued until 2034.

Legal Arguments and Defences

Sandilands' legal team, led by counsel Scott Robertson SC and Philip Boncardo, contends that the incident does not constitute a serious or consistent breach of contract and did not cause "serious and imminent injury" to Kiis FM. Notably, two censors monitoring the program did not use the dump button during the segment, despite past breaches of decency provisions.

In response, ARN Media stated in an ASX filing that it will defend the claim, disputing the allegations and arguing the termination was valid under the Australian Consumer Law. The broadcaster highlighted the early stage of proceedings, making it unable to estimate the outcome or financial impact reliably.

Contract Details and Financial Implications

Under the agreement between ARN and Quasar, Sandilands was entitled to annual compensation including $7.4 million in cash, a $200,000 consultancy fee, a $120,000 flight allowance, and contra air time valued at $500,000. Sandilands seeks a court order for specific performance of the contracts, payment of due amounts, and damages for economic and non-economic loss.
