A mother-of-three who is a United States citizen has initiated legal action against Immigration and Customs Enforcement (ICE) following a distressing incident on Mother's Day, where federal agents smashed her car window and arrested her husband in front of their terrified children. The event, captured in viral bystander footage, has sparked accusations of 'state-sanctioned cruelty' against the Trump administration.
The Arrest That Shocked a Family
On May 11, Kenia Guerrero was driving to church with her husband, Daniel Flores Martinez, and their three young children in a Boston suburb when their vehicle was suddenly surrounded by several unmarked cars. Approximately five armed, plain-clothes agents approached the family's car without identifying themselves or stating which agency they represented, according to the federal lawsuit.
Video evidence shows the officers breaking the passenger side window after Guerrero pleaded with them not to use violence, emphasizing that three children were inside the vehicle. Agents then aggressively pulled Flores Martinez from the car, slammed him to the ground, and placed him in handcuffs, despite his assurances that he was not resisting arrest.
Traumatic Aftermath for the Children
"We were getting ready to celebrate Mother's Day. By afternoon, my children were crying, asking why masked men broke into our car and took their father away," Guerrero stated in a declaration shared with The Independent. "I told them I didn't know. No mother should ever have to say that. This wasn't justice. This was violence. And my children will never forget what they saw."
The children, all US citizens aged 3, 12, and 14, were forced to witness their father's arrest, with one child diagnosed with epilepsy, hydrocephalus, and cerebral palsy. Guerrero herself was restrained against the car by an officer when she attempted to exit and check on her husband, leaving her helpless as the agents brutalized him.
Legal Allegations and Broader Context
The lawsuit, filed by Boston-based Lawyers for Civil Rights, accuses ICE of illegally deploying 'smash and grab' tactics to target immigrants and their families. It alleges intentional infliction of emotional distress, false imprisonment, assault, and battery, seeking compensatory damages for the trauma inflicted.
Mirian Albert, senior attorney at Lawyers for Civil Rights, condemned the incident, stating, "There is no justification for what happened to the Guerrero family. This was not enforcement. It was state-sanctioned cruelty, unleashed on a family without warning, without cause, and without conscience. The government must answer for the trauma it inflicts on children."
The arrest of Flores Martinez was among nearly 1,500 in Massachusetts that month, part of a wave of lawsuits alleging unlawful arrests and abuse by ICE. The complaint argues that this was not an isolated case but reflects a 'pattern and practice sanctioned and ratified by ICE leadership,' integral to the agency's enforcement regime.
