While the sister testified she witnessed the teenager being held against a wall by her throat, this claim was not confirmed by the complainant herself. Additionally, the sister suggested there were two separate altercations, whereas the complainant identified only one incident.

Magistrate Lucas Swan expressed serious concerns about the teenager's credibility as a witness, noting multiple inconsistencies in her testimony and what he described as an "evasive approach to simple questions." The magistrate stated plainly, "I had serious questions about her reliability as a witness of truth," highlighting the fundamental problems with the prosecution's case.

The complainant's shifting narrative further undermined her credibility. Initially claiming she hadn't struck Fallon at all during the altercation, she later maintained she had acted in self-defence when pressed on the matter. Magistrate Swan observed, "Clearly, there can be no confusion about a person punching an individual," suggesting the witness's changing account raised significant doubts.

Adding to the courtroom drama, the magistrate noted that contempt of court proceedings had been raised after both the teenager and her sister left the court without permission during the hearing, further damaging their credibility.

Charges Dismissed and Career Implications

Following the defence's arguments and the prosecution's concession that the assault might not be proven, Magistrate Swan dismissed all charges against Fallon and declined to issue an apprehended violence order. The Tongan international, who was flanked by family members throughout the proceedings, left court without comment.

Following her initial arrest, she had been banned from playing under the NRL's "no fault" stand-down policy, though she remained on the Parramatta Eels roster with the club's support throughout the court proceedings.
