Landmark Scottish Conviction for Domestic Abuse Culpable Homicide
A man has been found guilty in a groundbreaking Scottish prosecution for the culpable homicide of his wife, who took her own life after enduring a prolonged campaign of domestic abuse. This case represents the first of its kind in Scotland, setting a significant legal precedent.

Lee Milne, 39, from Dundee, was convicted at the High Court in Glasgow for the culpable homicide of his 28-year-old wife, Kimberly Milne. He was also found guilty of engaging in a course of abusive conduct towards her. Milne had denied both charges but was found guilty following a trial.
Details of the Abuse
The court heard that the couple began their relationship in late 2021, with the abuse commencing shortly thereafter and continuing until Kimberly's death in July 2023. They married in 2022, and prosecutors detailed 18 months of significant domestic abuse leading up to the tragedy.
Kimberly Milne died after jumping from a motorway bridge. Before her death, she had reported multiple incidents to the police, including a 2022 event where Milne choked her. "He put both hands around my neck and pinned me against the kitchen wall," she told officers, describing how he later apologised and claimed he was "not that type of guy."
In another late 2022 incident, she reported: "Lee repeatedly punched my ribs and I was begging him not to hurt me but he was not listening. I slept with a knife under my pillow as I was so frightened of him." The court also heard that Milne had pulled her to the ground by her hair on one occasion.
Legal Proceedings and Sentencing
Milne argued he was not responsible for Kimberly's death, citing her longstanding mental health issues and previous suicide attempts. However, the prosecution successfully demonstrated the causal link between his abuse and her suicide.
Prosecutor Alex Prentice KC stated after the verdict: "It is obvious the quite far-reaching effect Kimberly's death has had. They recognise that she had difficulties of her own, but the circumstances of the death brought great misery for the family, perhaps unlikely from which they will truly recover."
The court was informed that Milne has previous convictions for assault, resisting arrest, and driving offences. He has been remanded into custody and is scheduled for sentencing on 10 April. Judge Lady Drummond addressed Milne, noting: "It will be obvious to you that these are very serious offences which have caused harm and upset to Kimberly's grieving family."
