Tragic Death of Four-Year-Old Leads to Felony Charges Against Mother and Boyfriend
A shocking case of alleged neglect has emerged from Indiana, where a mother and her boyfriend are facing serious criminal charges following the death of her four-year-old special needs son, who was reportedly locked in a basement closet for extended periods. The child, Malichi Allen Lovely, was found unresponsive on March 23, leading to arrests and a devastating investigation into his care.
Details of the Alleged Neglect and Fatal Incident
Angel Lovely, 37, of Beech Grove, and Nicholas Bergdoll, 37, of Indianapolis, have been charged in connection with Malichi's death. According to police reports, the couple stated that Bergdoll discovered the toddler unresponsive in the basement. However, further investigation revealed a pattern of disturbing neglect. Lovely's other children told authorities that Malichi, who suffered from cerebral palsy and hydrocephalus and was fed through a tube, spent most of his time in a closet under the basement stairs and was sometimes locked inside.
One child reported hearing Malichi gagging in the closet on the day he died, while another described finding him with blood in his mouth and his head rolled back. Lovely allegedly admitted to placing the boy in the closet around 7 a.m. to sleep, claiming he had been awake for days, but her checks were insufficient. She also confessed to not refilling his seizure medication and acknowledged he was underweight, weighing only 22 pounds at death.
Systemic Failures and Prior Interventions
This tragedy follows a history of child welfare concerns. Malichi had been placed in foster care in 2024 due to medical neglect, and despite social workers strongly advising against it, Lovely was granted full custody in 2025. A search warrant executed after his death described the home as "unkempt and dirty," with unwashed dishes, dirt-covered floors, and strong odors of cat litter and body odor.
Bergdoll allegedly told investigators he did not agree with putting Malichi in the closet but felt it was not his place to intervene, stating it wasn't his role to "tell [Angel] how to raise her kid." Marion County Prosecutor Ryan Mears commented, "Children depend on the adults in their lives for protection and care, and in this instance, this child was failed by the accused. The allegations in this case are absolutely devastating."
Family Grief and Legal Proceedings
Malichi's biological father, Alexander Schmidt, 35, expressed profound grief on social media, apologizing to his son and vowing to protect his siblings. Schmidt described a turbulent relationship with Lovely, limited access to his children, and learning of Malichi's death through news reports of Lovely's mugshot. The family's obituary remembered Malichi as "more than a headline" and emphasized that his life mattered deeply.
Lovely faces two level-one felony counts of neglect of a dependent resulting in death, while Bergdoll is charged with two counts of level-three felony neglect of a dependent resulting in serious bodily injury. An autopsy is pending to determine the exact cause of death, as the community grapples with this heartbreaking loss.
