Father Jailed 14 Years for Fatal Beating of Five-Year-Old Son

A Queensland father who fatally beat his five-year-old son has been sentenced to 14 years in prison, with the court hearing the boy endured prolonged abuse before his tragic death. Jason Ross Allan Fourmile, aged 28, pleaded guilty to eight charges in the Supreme Court in Cairns, including manslaughter and multiple counts of child abuse.

Horrific Abuse Leading to Death

Caiden, who weighed only 20 kilograms, suffered extensive injuries at the hands of his father in August 2022. The court heard that Fourmile, who stands approximately 180 centimetres tall, was physically abusive toward his son during the period the child was in his care. This abuse included smacking Caiden on various body parts, pushing him to the floor, and even hitting his head against a brick wall.

Final Moments and Hospitalisation

In the days leading up to August 17, 2022, Fourmile would leave Caiden locked alone in a room. On that fateful day, other occupants of the home heard loud banging from the bedroom before Fourmile yelled "get up, Caido" and took the unresponsive boy to the shower. Caiden was rushed to Yarrabah Hospital by ambulance, where he was intubated before being transferred to Townsville via Lifeflight.

Medical examinations revealed catastrophic injuries including a broken collarbone, finger marks around his neck, and open wounds on his legs that appeared to have been caused by Fourmile beating him with his mobile phone. Police later found blood on the device. Caiden underwent emergency brain surgery to relieve swelling and abdominal surgery to remove 15 centimetres of his bowel, which doctors described as "extremely compromised."

Life Support Withdrawn

Despite extensive medical intervention, Caiden showed no signs of brain activity when his sedation wore off. Life support was removed, and the five-year-old boy passed away on August 22, 2022. Forensic pathologists determined that many of his injuries had been inflicted several days before his hospitalisation.

Mother's Heartbreaking Testimony

During sentencing submissions, Caiden's mother Bianca Allan described suffering "endless and paralysing" pain and trauma from losing her son. "The pain is constant and so is the reminder that I will never get to hold my little boy in my arms again," she told the court. Ms Allan revealed she is haunted by intrusive thoughts about her son's final hours, with the horror "seeping into every part" of her life.

Justice Delivered in Court

Justice James Henry made a point of telling Fourmile that his manslaughter conviction wasn't "merely a case of negligence." "You took the life of your five-year-old son," Justice Henry said. "That poor little boy must have endured prolonged pain and fear at your hands, his father."

Crown prosecutor Dejana Kovac told the court that Fourmile had a history of domestic violence dating back to 2016, including multiple breaches of Domestic Violence Orders and several failed intervention attempts. The court also heard that Fourmile had lied to police upon his arrest, initially claiming Caiden became unresponsive after choking on food.

Sentencing Considerations

Justice Henry considered Fourmile's troubled childhood, during which he was subject to physical and sexual abuse, along with his poor mental health and substance abuse issues. However, these factors did not mitigate the severity of the crimes against his own child.

Fourmile will be eligible for parole in 2033, having already served three-and-a-half years behind bars. He hung his head while listening to Ms Allan's testimony from just metres away in the court dock, a stark contrast to the violence he inflicted on his defenseless son.

The case has highlighted the devastating consequences of domestic violence and child abuse, particularly within vulnerable communities. Caiden had been living with his mother in Cairns but moved to Yarrabah, an Aboriginal community, to live with his father when his mother commenced her studies. Fourmile had given up his job to look after Caiden, who moved into a bedroom of the house shared with Fourmile's partner and three other children.
