British Father Faces Thai Prison After Mistakenly Taking Phone in Bar
Rory McColl, a 37-year-old father from Edinburgh, is confronting the terrifying prospect of imprisonment in Thailand following a simple misunderstanding in a Bangkok bar. His family has revealed that he has been stranded in the Southeast Asian nation for nearly a month, unable to return home to his son and job after accidentally picking up a woman's mobile phone, which he mistook for his own.
Holiday Nightmare Begins Hours After Arrival
The incident occurred on March 9, mere hours after McColl arrived in Bangkok for a holiday. According to his sister, Joanna McLaughlin, he typically keeps his phone in his pocket but had forgotten he was using a travel waist bag for valuables. When he reached for his device and could not find it, he noticed an identical phone on the bar, assumed it was his, and placed it in his pocket.
The woman who owned the phone witnessed this and immediately involved the police, believing it had been stolen. By the time McColl realised his error, officers were already arresting him and confiscating all his belongings. He spent the first two nights of his trip in what he described as horrendous conditions in a filthy Thai jail cell.
Bail and Passport Seizure Leave Him Stranded
After paying £1,000 in bail money to secure his release, police seized McColl's passport, leaving him effectively trapped in Thailand. He is now awaiting a court date while staying in a budget hotel in Pattaya, with his family deeply concerned about potential sentencing. Grim Thai prisons like Klong Prem Central, known for its brutal reputation, or the overcrowded Bang Kwang Central, loom as possible destinations if convicted.
McLaughlin expressed the family's desperation, stating, "We are extremely concerned that the police are still talking about jail sentences when he is innocent of the crime of theft." She added that McColl, who works at Buck's Bar in Edinburgh, must return for his son and employment, but the legal process has left him in limbo.
Financial and Legal Struggles Mount
The situation has also triggered significant financial strain. Loved ones have launched a GoFundMe appeal to cover living expenses and mounting legal fees, as McColl's travel insurance does not cover costs from missing his flight home or extended hotel stays. McLaughlin noted, "A lawyer will be very expensive. He has already had to pay £1,000 bail money and various payments to the police."
Despite seeking assistance, the British Embassy advised that they cannot intervene in criminal cases, leaving McColl to navigate the Thai legal system alone. His family continues to advocate for his return, emphasising the accidental nature of the incident and the severe consequences he now faces in a foreign country.
