Kristen Naylor, a 29-year-old from Lowton, Wigan, has been banned from drinking alcohol for three months after throwing a flapjack at a police officer's genitals while in custody, having earlier missed with a Pot Noodle. The incident occurred after Naylor was arrested for assaulting his father.
Attack on Father
Prosecutor Katie Lord told Bolton Crown Court that Naylor's father, John, had been staying at his mother's home following an operation. Naylor left for about an hour and returned in a 'very drunk' state. An argument ensued, and John said he had 'had enough' and attempted to leave with his two dogs, stating he knew what the defendant was like when drunk. Naylor followed, demanding his dog back, and tried to snatch a lead before putting his head against his father's and threatening him. He then punched his father's head repeatedly.
John moved away, crossing the road to ask a neighbor to look after the dogs. Naylor threatened, 'If you touch my dog I'll kill you.' He continued to follow John and punched him numerous times, causing him to fall. The attack lasted about 45 seconds, during which John pleaded to be allowed to get up. One of the dogs was caught by Naylor during the assault.
Police Response and Custody Incident
Police were called, and PC Shepherd attended. Naylor told the officer, 'I could make your life hell.' He was obstructive while being placed in a van and taken to custody. At the station, he was given a Pot Noodle and a flapjack. He threw the Pot Noodle at the officer but missed, then threw the flapjack, which hit the officer in the genitals, causing 'a sharp and immediate pain.' Judge Kenderik Horne remarked, 'I think he also felt sick.'
Sentencing
Naylor's defense barrister, Richard Bridgen, did not advance mitigation after the judge indicated the likely sentence. Naylor was sentenced to 12 months in prison, suspended for 18 months. He was ordered to complete 100 hours of unpaid work, 10 rehabilitation activity requirement days, a three-month alcohol abstinence and monitoring requirement, and a six-month mental health treatment requirement. He must also pay £150 in prosecution costs.
Naylor pleaded guilty to assault occasioning actual bodily harm, causing unnecessary suffering to a protected animal, and assaulting an emergency worker by beating.
