A nurse who faced disciplinary action after using incorrect pronouns for a transgender patient has won a settlement from her NHS trust employer. Jennifer Melle, a 41-year-old from Croydon in south London, claimed she was subjected to racial abuse by a transgender patient at St Helier Hospital in Carshalton in May 2024, following her use of the term "Mr" to address them.
Incident and Initial Warning
The incident occurred when Ms Melle, who has worked at the hospital for 12 years after moving from Uganda, referred to the patient as "Mr." She reported that this led to the patient directing racist language and physical threats toward her. In response, Epsom and St Helier Hospitals NHS Trust issued Ms Melle a written warning at the time, while also writing to the patient to emphasize that threatening and racist behavior would not be tolerated.
Suspension and Reinstatement
Ms Melle continued in her role until March 2025, when she was suspended with full pay after speaking to the media about her experience. The trust expressed concerns that press reports could potentially identify the patient, breaching confidentiality protocols. She was later reinstated to clinical duties in January following a private disciplinary meeting, which concluded that no further action would be taken regarding the alleged breach of confidentiality.
Settlement Agreement
According to the advocacy group Christian Concern, the NHS trust has now agreed to settle Ms Melle's claim ahead of a tribunal that was scheduled to begin on April 13. Ms Melle stated, "I cannot discuss the terms of the settlement, but generally I am glad that my employer has finally decided to extend an olive branch to me." She added that she looks forward to focusing on her job without facing accusations, emphasizing that no medical professional should endure such challenges for reporting abuse.
Ongoing Investigations
Despite the settlement, Ms Melle still faces ongoing investigations by the Nursing and Midwifery Council (NMC). She described her ordeal as "the darkest days of my life" and stressed that it remains unresolved. Ms Melle highlighted the broader implications, saying, "My ordeal matters not only for me, but for every nurse who should be able to practise according to conscience, biological reality, and basic safeguarding principles without fear."
Epsom and St Helier Hospitals NHS Trust and the NMC have been approached for comment on the matter. The case underscores ongoing debates around pronoun usage, patient confidentiality, and workplace protections within the NHS.
