Magaluf Gang Rape: Men Offered 'Free Sex' with British Teen to Strangers

In a shocking case that has drawn international attention, eight men have pleaded guilty to sexually assaulting an 18-year-old British tourist at a hotel in Magaluf, Spain. The incident, which occurred in August 2023, involved one of the attackers allegedly going into the hotel corridor and offering "free sex" with the victim to strangers returning from a night out.

Guilty Pleas and Reduced Sentences

Spanish public prosecutors had initially sought individual jail sentences of between 18 and 20 years for each of the eight men, totaling 151 years. However, as the trial was set to begin, the defendants agreed to plead guilty in exchange for reduced prison sentences. The new sentences amount to just over 73 years in total, a significant reduction from the original demands.

The accused include seven French nationals and one Swiss national, some of whom have been held in remand since their arrests in 2023. Two of the suspects were detained abroad on European Arrest Warrants and extradited to Spain, while six were arrested in Majorca.

Details of the Attack

According to a 14-page indictment from public prosecutors, the attack took place at the BH Mallorca Resort in Magaluf. The document describes how the British teenager was subjected to "sickening and degrading treatment" over approximately half an hour. Reports indicate that three of the suspects met the victim earlier while partying in Magaluf before the assault occurred.

Prosecutors stated that the men, aware of the victim's semi-conscious or unconscious state, stripped her naked, leaving only her bra on, and carried out various sexual acts without her consent. The indictment details that she was raped "in all manner of ways," spat on, and hit on her bottom, while the gang shouted insults at her.

Filming and Sharing of the Assault

A particularly disturbing aspect of the case involves the filming and sharing of the sexual attacks. Two of the men are accused of sending recordings from their phones and sharing them on Snapchat, boasting about their actions while the victim was still "semi-unconscious or unconscious." One suspect allegedly filmed 14 videos lasting 170 seconds, while another filmed five videos lasting 142 seconds.

As part of the plea bargain, five men who penetrated the victim accepted jail terms of nine or 11 years for sexual assault, with three receiving higher sentences due to repeating their crimes. They were also sentenced to an additional two years and three months for filming the attacks. The three men who did not penetrate the victim but filmed the assaults received prison sentences of two years and three months, with one receiving an extra four-year sentence for sexual assault without penetration.

Legal Proceedings and Deportation

The men, aged between 18 and 26 at the time of their arrests, faced charges including five counts of rape involving two or more men simultaneously, one count of sexual assault without penetration, and privacy crimes related to the mobile phone videos. They are identified in the indictment as primary authors of rape or accomplices who knowingly united in the commission of the sex crime.

It is expected that the defendants will be deported to their home countries after serving part of their sentences, though the exact duration of their imprisonment will be decided next month. Sources suggest they could be deported after six or seven years, but public prosecutors are likely to argue for full sentences to be served.

Hotel Response and Investigation

Following the incident, the BH Mallorca Resort issued a statement expressing deep regret and solidarity with the victim, while cooperating fully with authorities. The Civil Guard in Majorca described the investigation as complex, noting that the alleged aggressors did not form a single group of friends but joined the attack sporadically, encouraged by other participants.

The investigation led to the arrest of six suspects on the day of the attack, with two others apprehended later through European Arrest Warrants. One suspect was reportedly arrested after Spanish police used the victim's "stolen" mobile phone to locate him, while others were identified based on descriptions provided by the then-18-year-old victim.

This case highlights the severe consequences of sexual violence and the importance of international cooperation in bringing perpetrators to justice, even as it raises questions about plea bargains and sentencing in such horrific crimes.
