An internet personality known for broadcasting himself using hateful language was taken into custody in Nashville after allegedly refusing to settle a restaurant bill of nearly $400. Dalton Eatherly, 28, who streams under the alias Chud the Builder, was ejected from Bob's Steak and Chop at the Omni Hotel on Saturday when staff discovered he was livestreaming without approval.

Confrontation at the Restaurant

According to the arrest affidavit obtained by The Tennessean, employees had asked Eatherly not to film any content. The document noted that 'the defendant is a live streamer who filmed content including racially charged content on Broadway for social media.' After ordering two entrees, cocktails, and appetizers totaling $371.55, the restaurant realized he was recording and requested him to stop. The affidavit states that 'he became disruptive and started making racial statements, yelling, screaming and otherwise creating a scene at the location.' Eatherly allegedly told staff, 'I'm not paying if you are kicking me out,' before departing.

Video Evidence

A video posted on X, apparently recorded by Eatherly, shows him speaking to two employees. He told them, 'You seem kinda upset,' to which they replied it was 'time to go.' Eatherly then used a racist slur for people of Indian descent and said, 'Go take a s*** in the street,' multiple times. He added, 'Oh no, we're not paying s***. Y'all are kicking me out or are we staying?' Staff insisted he would 'pay then leave,' but Eatherly responded, 'Buddy, I didn't get to enjoy my meal. You're kicking me out. I'm not paying for s***,' before using another derogatory term. As he exited, he shook hands with an incoming patron and advised against eating there.

Arrest and Charges

Police found Eatherly walking on Broadway and attempted to arrest him. He initially pulled his arm away but was subdued without further incident. He was charged with theft of services, disorderly conduct, and resisting arrest. In a video of the arrest, he asked officers, 'What did I do?'

Eatherly's Account

On Monday, Eatherly shared his perspective on X. He claimed, 'I partially ate the two appetizers I ordered. Never got my meal, and couldn't enjoy or finish the food I did get.' He alleged that staff said 'ok just go then' and that he was kicked out because 'people watching the stream are offended.' He also stated he was interviewed by the FBI and a Domestic Terrorist Detective for about two hours, who asked if he was 'part of some organization.' Eatherly replied, 'No sir I'm just a dude with a camera.' He added that his phone was seized as evidence and he spent 13 hours in custody. In another controversial post, he claimed that in a cell with people of color, '90 percent' of them loved him and some stood up for him against others, whom he referred to with a derogatory slur.

Jail records show he was released the following morning at 11:21 am. The Daily Mail has reached out to Eatherly and the Davidson County Circuit Court Clerk for comment.
