In a significant enforcement action, the UK communications regulator Ofcom has levied an £800,000 fine against a pornography website for failing to implement mandatory age verification checks to prevent children from accessing its content. The penalty targets Kick Online Entertainment SA, following a detailed investigation that uncovered breaches of online safety regulations.

Investigation Reveals Compliance Failures

Ofcom's probe determined that Kick Online Entertainment SA did not comply with age-check requirements between July 25 and December 29 of last year. These rules, which form part of new online safety protections for children, mandate that so-called "risky" sites and apps use highly effective age verification methods. The goal is to identify underage users and block their access to pornography, as well as other harmful material including content related to self-harm, suicide, eating disorders, and extreme violence.

Additional Penalties for Non-Cooperation

Beyond the substantial fine for age-check failures, Ofcom has also imposed a separate £30,000 penalty on Kick for failing to respond accurately, completely, and in a timely manner to the regulator's information requests. Furthermore, the company faces a daily penalty of £200 until it provides the required information or for a maximum period of 60 days, whichever occurs first. This underscores the regulator's commitment to rigorous enforcement.

Regulatory Context and Broader Scrutiny

The new online safety protections for children officially came into force on July 25, marking a pivotal shift in digital governance. Shortly thereafter, on July 31, Ofcom launched investigations into 34 pornography sites operated by four companies: Kick Online Entertainment, 8579 LLC, AVS Group Ltd, and Trendio Ltd. These sites were prioritised based on the potential harm risk posed by their services and their substantial user bases, collectively attracting over nine million unique monthly visitors from the UK.

Commitment to Child Protection

Suzanne Cater, Ofcom's Director of Enforcement, emphasised the non-negotiable nature of these protections. "Having highly effective age checks on adult sites to protect children from pornographic content is non-negotiable," she stated. "Any company that fails to meet this duty – or engage with us – can expect to face robust enforcement action, including significant fines." Cater added that Ofcom continues to investigate other sites under the UK's age-check rules and will take further action as necessary.

Since the investigation, Kick Online Entertainment SA has introduced an age-check method that Ofcom describes as "capable of being highly effective." This development highlights the potential for compliance, but the fines serve as a stark warning to other operators in the industry. The enforcement actions reflect a broader regulatory trend towards holding online platforms accountable for safeguarding minors, with significant financial and operational consequences for non-compliance.
