New York Vodka Producer Files Legal Action Against LIV Golf Over Brand Dispute
The Saudi Arabia-funded LIV Golf tour is confronting a fresh legal challenge, this time from a New York-based vodka distillery. Long Island Vodka, also operating as Long Island Spirits, has initiated a lawsuit alleging that the professional golf circuit is infringing upon its trademark and causing significant consumer confusion.
Allegations of Blatant Trademark Infringement
In a formal complaint submitted to the federal court in Central Islip, New York, the distillery accuses LIV Golf of "blatant trademark infringement." The core of the dispute revolves around LIV Golf's commercial activities, including partnerships with beverage companies like Treasury Wine Estates and DAOU Vineyards. These collaborations have led to the promotion and sale of drinks such as the LIV Clubhouse Cooler, LIV Transfusion Cocktail, and LIV It Up Bloody Mary at tournaments and in advertisements.
The distillery contends that this has "swamped" its own brand, leading to a depressing effect on sales. Established in 2007 within a converted horse barn on Long Island's North Fork, the company produces a range of spirits, including its signature LíV vodka made from locally sourced potatoes, alongside whiskeys, liqueurs, and cocktails. It also markets its own line of branded merchandise, including t-shirts and hats.
Consumer Confusion and Brand Damage Claims
The legal filing states that distributors, retailers, hospitality partners, and consumers have already experienced actual confusion regarding a potential affiliation between the LíV vodka brand and LIV Golf. The complaint argues that any mistaken belief among consumers that LíV is associated with what it describes as a "highly controversial and heavily commercialized venture" backed by Saudi sovereign wealth is fundamentally at odds with the authentic, craft spirit image the distillery has cultivated.
"Consumers’ mistaken belief that LIV is in league with a highly controversial and heavily commercialized venture backed by an immense foreign sovereign wealth fund is antithetical to the authentic, pioneering, craft spirit LíV brand that LIV has worked hard to build," the complaint elaborates.
Legal Remedies Sought and Broader Context
Long Island Vodka is seeking several legal remedies through this lawsuit:
- Compensatory damages for alleged financial losses.
- Punitive damages, citing willful infringement by LIV Golf.
- An injunction to prevent LIV Golf from using the "LIV" mark in connection with alcohol and apparel sales.
LIV Golf, which was founded in 2021 with financing from Saudi Arabia's Public Investment Fund as a rival to the traditional PGA Tour, did not provide an immediate response to requests for comment on the lawsuit. The tour has frequently faced criticism as a potential tool for sportswashing, aimed at diverting attention from Saudi Arabia's human rights record.
This is not the first trademark-related legal issue for LIV Golf. The organization has previously been involved in disputes with other entities, including sportswear giant Adidas and the owner of the LIV nightclub in Miami Beach, Florida, over similar intellectual property concerns.
